Beacon Terms of Service


Welcome! THE FOLLOWING SETS FORTH THE TERMS AND CONDITIONS THAT APPLY TO YOUR USE OF Beacon (“Beacon”) AND ASSOCIATED SERVICES OPERATED BY ADMITSEE INC (“Company”).

1. Purpose of the Terms
The purpose of Beacon’s Terms of Service (“Terms”) is to state the agreed terms between the Company and the service user (“Member” and/or “User”) who uses the services provided by Beacon (“Services”). By using Beacon, you agree to be bound by these Terms, and any purchase placed by you are bound by these Terms. If you do not agree to these Terms and Conditions, you should not use Beacon.

2. Description of Beacon
Beacon is an online admissions assessment service based on the collection and assessment of data, providing admissions statistics content, and advisory service for its Members who can share their credentials to obtain information through Beacon. You acknowledge that the Company’s trade names, trademarks, service marks, logos, domain names, and other distinctive brand features are the intellectual properties of the Company which you are not permitted to use save with the Company’s prior authorization in writing.

The Company makes no representations, warranties (full or limited) or guarantees and accordingly shall not be held liable about the accuracy, completeness, or reliability of any content, data, and service provided on this website, including but not limited to the content of the report, admissions content, and premium/paid services provided by Company or its experts, and expressly disclaims liability for any errors of any information, content, advertisements, or other material contained on, distributed through, or linked, downloaded or accessed from our service. All information contained herein is provided by Beacon members and nonmembers. Although the Company makes every effort to present accurate and reliable information, the Company does not endorse, approve, or certify such information nor does it accept any responsibility and the Company shall not be held liable for any damages arising out of any reliance upon it or the outcomes of decisions user may make in reliance upon any information provided by Company whatsoever. Use of content information is voluntary, and therefore should only be acted upon after an independent review of its accuracy, completeness, and reliability. Reference to any specific commercial product, process, or service by trade name, trademark, service mark, manufacturer, or otherwise does not constitute or imply the Company’s endorsement, recommendation, solicitation or favoring.

The Company, its staff, employees, and agents, accepts no responsibility for any consequences resulting from the use or reliance of any information herein, or from use of the information obtained at linked Internet addresses, or in any respect for the content of such information, including (but not limited to) errors or omissions in contents herein.

On certain pages on Beacon’s Internet site, live links to other Internet addresses are accessible. Such external Internet addresses contain information created, published, maintained, or otherwise posted by institutions or organizations independent of the Company and Beacon. The Company does not endorse, approve, certify, or control these external Internet addresses and accordingly accepts no responsibility and does not guarantee the accuracy, completeness, efficacy, timeliness, or correct information located at such addresses. Use of any information obtained from such addresses is voluntary, and reliance on it should only be undertaken after an independent review of its accuracy, completeness, efficacy, and timeliness. Reference on such sites to any specific commercial product, process, or service by trade name, trademark, service mark, manufacturer, or otherwise does not constitute or imply endorsement, recommendation, solicitation or favoring by the Company. The Company shall not be held liable for any damages arising out of any use of or reliance upon it.

There are three types of Members:
a. Free Member (a Member permitted to use the free section of the Service).
b. Premium Member (a Member permitted to use the premium paid section of the Service).
c. Institute Member (a Member permitted to use B-to-B service provided for institutes and schools).
The following are various terms relating to Services:
a. Free Services (assessment and contents provided in the free sections).
b. Premium Services (assessment and contents provided in the paid sections).
c. Admissions Report (section where it contains admissions assessment).
d. Contents (free and paid contents within the Services).
e. Comments (opinions offered by the Company’s experts).
f. Platform (online environment where Services is offered).

3. Acceptance of Terms by Member
In order to use the Services, you must first agree to these Terms listed on Beacon. You may not use the Services if you do not agree with the Terms. You may accept the Terms by clicking to accept or agreeing to the Terms where this option is made available in the user interface for any service. The Company reserves the right to revise the Terms from time to time and/or arbitrarily, and the revised Terms are presented to the Members 7 days prior to the first day of its application on the Beacon. You are by your continual use of Services automatically considered to have agreed with the revised Terms unless you declare to the Company in writing your disagreement within 15 days from the first day of notification of the changes is sent out to user.

4. User Agreements
Upon agreeing to the Terms, you are obligated to accept the following rules. Violation of any of Terms or rules mentioned herein will result in all privileges as a Member being revoked instantly. Additionally, any Member who attempts to access and distribute information put forth by the Beacon website, its agents, employees, or staff without the Company’s written permission shall constitute a breach of these Terms for which the Company reserves the right to seek damages and/or other legal remedies which may be available to it against you.
a. Input accurate and truthful information in the registration.
b. The Company has the right to use Members’ information to display customized advertisements within the Service.
c. The Company reserves the right to send emails to Members. The Company does not share any of your information without your permission except where such information does not constitute Personal Data. Also, contacting the Members via SMS messages or phone to notify beneficial opportunities and information is allowed only for Members who have agreed to the contact via phone option upon registration.
d. Members have the right to request termination of your membership at any time. However, there will be no refund for money already spent to purchase and access paid services or products including (but not limited to) the premium reporting section (Premium Account), Expert’s Commentary Service, Institute Service, Admissions Contents, and other paid services on the Beacon Platform. If cyber cash remains in the membership account upon termination request, the Company may postpone the termination of the membership until full depletion of the cyber cash takes place. The Company will delete all of a Member’s information upon account termination or within a reasonable time thereafter provided your Personal Data will not be kept longer than is necessary for the fulfilment of the purpose for which the Personal Data is or is to be used.
e. The Company does not refund or reset account or give extra credits on report updates for any mistakes made by the user when using the system. Therefore, we suggest our users to be cautious before updating or generating the Beacon report or when purchasing paid products on our website.
f. All Contents, Admissions Reports, Comments, Services, and all intellectual and visual materials presented through Beacon is a copyrighted intellectual property of the Company for which you hereby expressly acknowledge. Members are forbidden from duplicating or distributing said information without the Company’s prior written authorization.
g. The contact information provided by Members may be used to provide students and parents with useful information from the Company's regional offices and partners.
h. You understand that the contents in the Content Store and Premium/paid Service (such as Roadmap Service, Essay Editing, Award Coaching, and any other additions to Premium Service section) provided by Company include opinions of various experts, students, surveys, and market research, and you understand that the validity of the content may be evaluated differently by each examiner. The Company does NOT guarantee the objective accuracy of information contained in such contents and services and shall NOT be responsible for the outcome from the user’s decision made in reference to the information provided by the Company. Also, due to the nature of content, once it is exposed to the user, the content’s value has been instantly fulfilled. Therefore, no Member will be granted the ability to cancel purchase or demand refunds once payment has been processed for the Company’s content(s).
i. Members do not hold any right to use the Company’s content for personal, commercial, and non-commercial purposes.
j. Number of updates to the Admissions Report by inputting new user information and generating a new report, such as grades, test score, activities, awards, intended majors, and more, will be limited in terms of the total number of updates for the users of Free and Premium accounts in order to prevent intentional mining of the Company’s intellectual properties. For Free account users, the number of upgrades is limited to a total of 2 times. For Premium account users, the number of upgrades is limited to a total of 5 times. However, if there is remaining number of upgrades from a Free account, it will be carried over to a Premium account.
k. The data shown in the school specific scattergram has been collected via offline and online sources. Although we have done our best to collect viable data, the data may contain errors or misrepresentation caused by the data provider or during the data collection process. Therefore, we do not guarantee the accuracy of each data nor are we responsible for users making any type of decision based on the data provided.
l. If you use the Share function in the Report, the information shown in your report, including your name, current school information, college choices, your acceptance likelihood at various colleges, major fit, and other information covered in the report will be shared with the recipient(s) of the email address(es) you have designated. However, certain sections of your report, such as parts of Holistic Evaluation and more, will not be viewable by the recipient. You cannot undo once report is shared and your shared report may be viewed by others besides the assigned email recipient(s) if the recipient decides to forward the email received to another third party or decides to upload the link to your report (or images of your report) on other websites. Company is NOT responsible for any consequences of sharing such information based on your request through the Share function.

5. Limitations of Liability
You acknowledge and agree that the Company may (permanently or temporarily) stop providing the Service (or any features within the Service) to you as a part of continuing innovation of the Service. If it causes Members significant and foreseeable disadvantages, the Company will send prior notification via the e-mail address provided by the Members used to create an Beacon account.

Beacon PROVIDES ADMISSIONS RELATED EVALUATIONS AND OPINIONS BASED ON LOGIC AND DATA OBTAINED BY THE COMPANY’S OWN RESOURCES AND NETWORKS. WE ADVISE THAT INFORMATION SHOULD NOT BE USED AS A FORECASTING TOOL, BUT USED ONLY AS A REFERENCE OR A GUIDE THROUGH THE ADMISSIONS PROCESS. CONTENT INFORMATION DOES NOT GUARANTEE ANY STATISTICAL ADVANTAGE FOR THE MEMBER’S (OR USER’S CLIENTS’) FUTURE ADMISSIONS OUTCOME. THE COMPANY IS NOT RESPONSIBLE FOR THE VALIDITY OF THE SUGGESTIONS IN ADMISSIONS REPORTS, ADMISSIONS CONTENTS, AND EXPERT’S COMMENTS, NOR IS IT RESPONSIBLE FOR THE OUTCOME OF USER’S ADMISSIONS RESULTS.

The Company does not accept into membership and will not enter into an agreement with a minor or with a legal guardian for the usage of paid services for persons who are legal minors for the lack of legal capacity. The legal guardian or principal credit cardholder and/or holder of a Member’s Paypal account is solely responsible for keeping his or her own payment information safe from third persons. The legal guardian and/or principal cardholder is himself deemed by us as the user or Member, instead of the minor. If payment is made, the Company assumes that it has been confirmed with the guardian and/or principal cardholder and there will be no refund of any kind. Member confirms understands that they have reached the age of majority and acknowledge the purchasing content from the Beacon Platform for use on the above basis.

6. Possible Cancellation of User’s Account
The Company reserves the right to disallow your request to register on the Services or cancel your account under the following circumstances:
a. Usage of a fictitious or anonymous name.
b. Omission of information or use of false information.
c. Conduct which violates the Terms.
d. Attempts to infringe the Company’s intellectual property rights; including (but not limited to) contents, assessment logic, input methods, visual representation, and all other relevant aspects of the website.
e. Any instance of harassment, libel, or other form of harm or nuisance expressed towards other Members, AdmitSee employees, staff, or agents.
f. Illegal use of another person’s identity or submission of false information.
g. Any attempts to change Beacon’s client program or efforts to hack Beacon or any linked website, content, information, or Member information.
h. Copying, modifying, or creating a derivative work, committing reverse engineering, decompiling contents, or otherwise attempting to extract the source code of the software given on the Beacon website by the Company without permission from the Company.
i. Collecting personal information such as email addresses.
j. Committing any crime or any illegal actions including but not limited to plagiarism. Based upon the severity of a case, the Company may terminate membership without warning or refund. You understand and agree that you may be held liable for all consequential damages inflicted upon the Company and other Members.

7. Communication in the Services
Communication consists of any data files, written text, music, audio files, photographs, videos, digital or other information within Beacon. The Company holds complete ownership and management rights in providing the Services to its Members.
Your comment(s) may be removed, switched to private mode, refused registration, or your membership to the Service may be limited or canceled if your content contains any insulting or slanderous messages towards another Member or a third party. The Company shall not be liable for any comments listed by Members or Experts on Beacon whatsoever.

8. Protection of Personal Information
The Company is responsible for obtaining a security system to protect your personal information. The Company will destroy personal information upon termination of your membership or within a reasonable time thereafter provided your Personal Data will not be kept longer than is necessary for the fulfilment of the purpose for which the Personal Data is or is to be used.

9. Cancellation of Membership
Members may request for cancellation of membership at any time and for any reason by clicking “Delete Account” under Account Info or by contacting us at support@admitsee.com. Premium accounts may be canceled at any time, but service related fees (such as Premium upgrade fees, fees for paid contents) are non- refundable. Information members provide may remain on the servers after cancellation, but will not be accessible by outside personnel.

10. Liability and responsibility of the Company
The Company is responsible for providing continuous and stable services to the best of its abilities for all Members. However, the Company may temporarily stop the Services or suspend communication for the purposes of inspecting or diagnosing its systems and for other management or maintenance reasons. The Company must build a security system and obey privacy policy to protect the safety of Members who agree to use Beacon’s Services.

The Company does not accept any liability whether on the free or paid contents of the Service. The Company is excluded from its liabilities in the case of war, natural disaster, a partner’s withdrawal from the Service, or a malfunction in the e-mail conformation service provided by a third party. The Company is excluded from its liabilities in the case of repair, exchange, regular inspection, or construction of the Services which Members may be notified of beforehand or may take place unexpectedly. The Company does not accept any liability for the product warranties obtained from the Services or links provided by the Company or linked within Beacon. The Member is responsible for their own use or reliance of the contents or programs downloaded from the Services under the User or Member’s decision. The Company shall not be held responsible for any problems with the Member’s computer or network environment. The Company accepts no responsibility for reliability, accuracy, completeness, and content quality obtained from the Services. You agree that, as a Member, you will not raise any legal issues against the Company. These Terms shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice or conflict of law provision or rule (whether of the State of New York or any other jurisdiction).
